1. Purpose
These terms govern access to and use of the website apexmindset.fr (the “Site”), published by Tahé Sfaxi (the “Publisher”). By using the Site, you accept these terms. If you do not accept them, do not use it.
2. Description of the service
The Site offers a presentation of the Apex Mindset project, the Express Protocol (a five-minute guided session), a mental preparation AI Coach, a performance journal, a workload forecast and resilience exercises, the option to create an account to find your space, a paid Pro subscription, the Apex Club offer for organizations (clubs, high schools, school sports programs), the option to support the project with a donation, and a way to contact the Publisher.
3. A well-being tool, not a treatment
Apex Mindset is not a medical device, a health service or psychotherapy. The exercises offered aim to help you relax and focus; they do not diagnose, treat or cure any disease or disorder. They do not replace the advice of a healthcare professional.
- Stop an exercise if you feel discomfort, dizziness, faintness or pain.
- If you have health problems (respiratory, heart, anxiety disorders, pregnancy…), ask a doctor for advice before doing breathing exercises.
- Do not practice while driving, walking in the street or in any situation that requires your attention.
If you're going through a very hard time or thinking about hurting yourself, you're not alone. In France, call 3114 (national suicide prevention line, free, 24/7), 15 or 112 in an emergency, or Fil Santé Jeunes at 0 800 235 236 (free, anonymous). For a minor in danger or facing violence: 119. For online harassment: 3018. Elsewhere, call your local emergency number (112 in the EU).
4. Accounts and login
Some features require creating an account, with email and password or via “Continue with Google”. You agree to provide an accurate address, to keep your password confidential and not to use someone else's account. You can delete your account at any time by writing to contact@apexmindset.fr. Accounts are technically managed by Supabase (European Union); see the privacy policy.
5. Pro subscription, price and cancellation
The “Pro” subscription is offered at the price displayed on the Site (€4.99 per month, a price that may change with prior notice), with no minimum commitment. It includes: the AI Coach with unlimited messages, the workload forecast and its analyses, full adaptive resilience and the detailed journal history. The free “Discovery” plan includes, among other things, the Express Protocol, the journal and 10 messages per day to the AI Coach (messages expressing distress are never blocked). Members of an organization subscribed to Apex Club get the Pro features as long as their organization's space is active.
Payment is processed securely by PayPal (PayPal account or bank card, depending on the options offered by PayPal); Apex Mindset never sees or stores your banking data. The subscription renews automatically every month until canceled. Online cancellation: you can cancel at any time from the “Apex Pro” page (“Cancel my subscription” button) or from your PayPal account; Pro access then remains active until the end of the period already paid for, with no prorated refund unless the law provides otherwise. If a payment fails, access may be suspended until the situation is resolved. Right of withdrawal: since this is digital content supplied immediately, you may be asked to request access right away and to expressly waive your 14-day right of withdrawal; otherwise, this right applies under the conditions provided by law. 6. Apex Club (clubs, high schools, organizations)
How it works. Apex Club allows an organization (sports club, school, program…) to open a space that its members join with an invitation code. Each member keeps a private personal space. The coach sees the list of members (the first name each one chose) and, every week, the group's average perceived tension, calculated only with the members who agreed to share their stress level, and never over fewer than five people.
Commitments of the organization and the coach
- Inform families and obtain written consent from a parent for any member under 15 before they join the space (a template letter and consent slip are provided), and keep these consent forms.
- Never pressure a member to join the space or share how they feel: sharing is a free choice.
- Do not try to identify a member from the averages, or create fake accounts to do so.
- Use the trends only to adapt the support given to the group (workload, sessions, prevention), never to select, assess, grade or penalize a member.
- Share the invitation code only with members of the organization, and remove from the space anyone who is no longer part of it.
For members
Joining a club is optional. By joining, members confirm that they are 15 or older, or have their parents' consent. They can stop sharing or leave the club at any time from “My account”; they then keep their personal space. The journal, notes and conversations are never accessible to the organization.
Trial, subscription and termination
The space opens with a 30-day free trial, with no payment method required. The coach can activate the Apex Club subscription (€29 per month per organization, a launch price that may change with prior notice, with no minimum commitment) from their space, by secure PayPal payment, or by mutual agreement with the Publisher (including by invoice); if they activate it during the trial, the first payment only occurs at the end of the trial. They can cancel it online at any time from their space: the space remains active until the end of the period already paid for. The number of seats is set with the Publisher. Without activation, the dashboard and new memberships are paused. The Publisher may suspend a space if these commitments are not respected. The coach can delete the space at any time: the member list and group history are then erased; the members' personal accounts are not affected.
Supporting the project (donations)
Any adult may, if they wish, support the development of Apex Mindset with a voluntary donation via the Ko-fi platform. The donation is voluntary and involves nothing in return: it gives access to no feature or benefit, and creates no obligation for the Publisher. It is paid to the Publisher personally; since Apex Mindset is not a public-interest association, it does not entitle you to any tax deduction. Payment is subject to the terms of Ko-fi and its payment provider. A minor must not make a donation without their parents' consent. For any question about a donation: contact@apexmindset.fr.
7. Access and use
The Site is accessible to anyone with Internet access; connection and equipment costs are your responsibility. Use is restricted to personal, non-commercial purposes, except for the Apex Club offer described above. It is prohibited to: disrupt the operation of the Site, attempt to bypass its security, extract its content on a large scale, or use it for unlawful purposes.
8. The AI Coach
The AI Coach generates automatic replies using a third-party language model. Its replies may contain errors and constitute neither medical nor professional advice. Do not share sensitive information that could identify you. How it works and the data involved are described in the privacy policy.
9. Minors
The Site is open to high-school students. Minors under 15 must use the Site with the consent of a parent or legal guardian whenever personal data is shared (see Protection of minors).
10. Intellectual property
The Site and its content are protected (see the legal notice). The Publisher grants you a personal, non-exclusive and non-transferable right of use, limited to viewing the Site and doing the exercises offered.
11. Liability
The Site is provided “as is”. The Publisher guarantees no result (passing an exam, athletic performance, reduced stress), nor the absence of interruptions or errors. To the extent permitted by law, the Publisher cannot be held liable for indirect damage, or for use of the exercises contrary to the recommendations above. These provisions do not limit the rights you have under the law, particularly in the event of gross negligence or fraud, nor consumer rights.

See the privacy policy. The Site uses no cookies.
13. Changes
The Publisher may change the Site and these terms at any time. The applicable version is the one published on the date you view it. Significant changes will be announced.
14. Governing law and disputes
These terms are governed by French law. If there is a problem, contact us at contact@apexmindset.fr to seek an amicable solution. Failing that, the French courts shall have jurisdiction, subject to the mandatory provisions protecting consumers.
